General
Ludus is operated by Ludus-Language, Inc. These Terms govern your use of our apps and websites. By signing up or otherwise accepting these Terms, you agree to follow them. If you do not agree, do not use Ludus.
Additional terms may apply to purchases or particular services. If you use Ludus through a school, a signed school agreement takes priority where it conflicts with these Terms. Nothing here limits rights that cannot be waived under applicable law.
Your Account
Keep your account information accurate and your login details secure. Contact us if you suspect unauthorized access. You must be able to enter into this agreement or use Ludus with authorization from a parent, guardian, or school that has the necessary authority.
Anyone acting for a school or organization must be authorized to do so. Use by children under 13 requires parental consent or valid school authorization where applicable. School authorization covers educational use and does not replace any separate consent required by law.
Using Ludus
You may use Ludus for personal learning and authorized educational instruction. We grant you a limited, nonexclusive, nontransferable license for those purposes, subject to these Terms. Third-party materials and open-source software remain subject to their own licenses. App-store purchases and downloads are also subject to the applicable store terms and app license.
You must not use Ludus to break the law, harass or harm others, infringe their rights, or share their private information without permission. You must not steal accounts, impersonate others, bypass payment or access controls, introduce malware, disrupt the service, or manipulate results and rewards through fraud. Unauthorized scraping, automated access, and account resale are prohibited, except where permitted by law or an applicable license.
Subscriptions and Payments
Prices, billing periods, included features, and any trial conditions are shown before purchase. You agree to pay the disclosed charges and applicable taxes. Recurring subscriptions renew automatically unless canceled before the renewal deadline. Trials that convert to paid subscriptions follow the terms shown with the offer.
Manage Apple subscriptions through your Apple subscription settings. For direct purchases, use the subscription-management option provided with your purchase or contact us. Cancellation normally stops the next renewal, with access continuing through the current paid period. Deleting your account or uninstalling the app does not cancel a subscription.
Apple handles refund requests for purchases made through Apple. For direct purchases, email admin@ludusapp.com. Refunds are subject to the purchase terms and applicable law. We will give any required notice and obtain any required acceptance before subscription price changes take effect.
Paid features are available for the access period purchased. References to access to current or future activities and languages apply during that period. Trial and promotional offers are subject to the conditions disclosed with the offer.
Your Content
You retain any ownership rights you have in content you submit to Ludus. You grant us a worldwide, nonexclusive, royalty-free license to store, process, reproduce, and display it as needed to operate and support Ludus and provide sharing you choose. Our providers may do the same on our behalf. You must have the rights needed to submit and share your content.
This license ends when your content is deleted from our systems, except as needed for lawful retention, backup removal, or sharing you have authorized. Copies you have shared with others may remain available to them, subject to applicable law. Personal information is handled as described in our Privacy Policy.
Our Content
Ludus's software, branding, designs, and learning materials belong to us or our licensors. Using Ludus does not transfer ownership of them to you. You may not reproduce, distribute, sell, or otherwise exploit them beyond what these Terms, an applicable license, or law permits.
To report copyright infringement, email admin@ludusapp.com with your contact details, the content's location, and an explanation of your claim and authority to make it. We may remove infringing content and suspend or terminate accounts for repeated infringement.
Points and Rewards
Points, streaks, achievements, and other virtual rewards have no cash value and cannot be sold or transferred unless we expressly allow it. We may correct errors and reverse rewards obtained through abuse. Purchased benefits remain subject to the purchase terms and applicable law.
Availability and Changes
We may update, change, or discontinue features. For changes that materially affect a paid service, we will provide appropriate notice and any access, refund, or other remedy required by your purchase agreement or law.
Ludus may contain errors or experience interruptions. We do not guarantee a particular learning outcome. To the extent permitted by law, Ludus is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not override express purchase commitments or mandatory consumer guarantees.
Suspension and Termination
We may suspend or end access for a material breach of these Terms, fraud, security risks, unlawful activity, or legal requirements. Where reasonably practicable, we will give notice and an opportunity to resolve the issue; urgent risks may require immediate action.
You may stop using Ludus at any time. To request deletion of your account or personal information, email admin@ludusapp.com. Subscription cancellation is separate from deletion. If we end paid access without a breach by you, we will provide any remedy required by your agreement or law.
Liability
To the extent permitted by law, Ludus is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service. This does not exclude liability for fraud, fraudulent misrepresentation, or anything that cannot legally be excluded. Different terms may apply under a signed school agreement.
Privacy and Other Services
Our Privacy Policy explains how we handle personal information and respond to privacy requests. Accepting these Terms does not replace consent required by law.
Other websites and services linked from Ludus have their own terms and privacy policies. Review them before using those services.
Changes to These Terms
We may revise these Terms and will update the date on this page. We will notify you of material changes through Ludus or by email and obtain renewed acceptance where required. Changes do not remove existing rights or purchase commitments.
Other Terms
These Terms, applicable purchase terms, and any signed agreement covering your use form our agreement for those services. If a provision cannot be enforced, the remaining provisions continue to apply. Not enforcing a provision immediately does not waive it.
We may transfer this agreement as part of a business transfer, subject to applicable law and your mandatory rights. Ownership, accrued payment obligations, and applicable liability provisions continue after termination to the extent necessary.
